Here is information to guide you through your final 120 days and onto removal:
The final 120 days of your ignition interlock requirement are very important. This law requires that you complete a minimum of 120 days violation-free in order to qualify for program completion and device removal.
During the final one hundred twenty (120) day period for which the ignition interlock device is required, you cannot violate any of the following conditions:
- Tampering with, circumventing, or attempting to start the vehicle with a breath alcohol concentration in excess of 0.02% blood alcohol concentration; providing a passing retest within ten (10) minutes will nullify this violation if digital images associated with each test confirms that the same person performed both tests;
- Failing to take or skipping a rolling retest; however, you will not incur a violation if a review of the digital images associated with the test confirms that you were not in your vehicle;
- Failing a rolling test with a breath alcohol concentration in excess of 0.02%; however, you will not receive a violation if you provide a passing retest within ten (10) minutes and a review of the digital images associated with each test confirms that the same person performed both tests.
(It also important to note that you cannot violate the following conditions at any time during your requirement:
- Removing or causing to be removed the ignition interlock device at any time during the three hundred sixty-five (365) consecutive day period; and
- Failing to appear at the ignition interlock device provider when required for calibration, monitoring, or inspection of the device.)
If at any time during the final one hundred twenty (120) days of the time period the person is required to use a functioning ignition interlock device, the manufacturer or the Ignition Interlock Program determines that you have committed a violation, the 120-day period shall start again from the date of the violation. This will continue until you have completed 120 days violation free.
You are responsible for requesting a compliance review following your final monthly calibration appointment/data download.
Once you have had the device for 365 days and had a final download, then contact your device manufacturer to request a compliance review. They have 3 days to review the final 120 days of your requirement for any violations that may extend you on the program.

Once you have been notified by your manufacturer that your Certificate of Compliance has been approved, or you have received a "Remove Interlock Restriction" letter from the Department of Safety, you can go to a Driver Services Center to obtain a driver's license without an ignition interlock restriction.
When you have been issued a driver's license without the ignition interlock restriction, you will provide a copy of this license to your interlock manufacturer, and they will schedule your device removal.
*Do not remove your ignition interlock prior to obtaining your unrestricted license. Removing the interlock device early may cause the 365-day requirement to start over or extend you on the program for 120 days.
