An officer has arrested you with a DUI. Before anything can begin with the State, or installing an interlock device, you must have a court conviction first. Based off your offense, your license will be revoked or suspended (this means you lose your license). To get your license back, the following steps must be taken.
Step 1:
WITHIN 10 DAYS AFTER YOUR LICENSE STATUS HAS CHANGED
- First, you must have the Interlock device installed on your vehicle. Finding a Manufacturer & Service Center
- Second, you must obtain SR-22 auto insurance.
- Third, you must obtain your restricted license. Obtaining a Restricted Driver's License
YOUR INTERLOCK USAGE PERIOD WILL NOT BEGIN UNTIL THESE ARE COMPLETED!!
Step 2:
During the interlock usage period (the amount of time you were ordered to have the device installed) you will be responsible for:
- Getting the device checked "calibrated/serviced" every 30 days at a location dictated by your Interlock company.
- Violations on the interlock device
- Maintaining your SR-22 insurance
- Maintaining your license status
Failure to comply with any of the items above may result in extension of your interlock usage period.
Things that might happen along the way:
- I've wrecked my car, now what?
- What if I have more than one vehicle?
- What is a Violation?
- What if I drive for work?
- I can't breathe well enough to use the device. What do I do?
- Can I let someone else drive my car with an ignition interlock device installed?
Step 3:
The final calibration (last service) will determine if/when you can have the device removed. You are responsible for requesting a compliance check from your interlock company. Your provider will create and fill out a "Compliance Determination Form."
- If you fail: Your Interlock provider will notify you of your extended usage period and next final calibration. You can appeal these findings. Disputing a Violation Extension
- If you pass, your interlock company will send a certificate to the State.
The State will approve or deny the certificate of completion. This decision is based on your license status during your interlock usage process.
Approval = you can apply for your license without restriction and have the device removed
Denial = you keep the device until the date determined by the interlock company
